Order and Payment Policies
1) Order Placement
For anything that you see as available on our site, you can order online at outtheboxshop.com. All payments go through a third-party payment provider (Square or PayPal). We do not keep records of your payment information. No cash, check, or money order payments are accepted.
If you see our items available on eBay, you may order online at eBay.com through your eBay account.
2) Order Confirmation
We will send you an order confirmation to the e-mail address which you provided us within twenty-four (24) hours of placing an order. If you do not receive a confirmation, please check your Junk Mail or spam Filter to allow e-mails from @email@example.com. If you still do not see a confirmation, you may have entered your e-mail address incorrectly. Please contact us through our contact us page and allow twenty-four (24) hours for a response.
3) Order Status
Once your order has been shipped, you will receive a shipment confirmation e-mail with a tracking number.
If we are delayed in the processing or shipping of your items, we will send you a status update with the expected shipping dates.
4) Cancelling or Modifying an Order
You may cancel or modify all orders prior to receiving an order confirmation by sending an e-mail to @firstname.lastname@example.org with the subject line “Order Cancellation” or “Order Modification”. If the order is a cancellation or a reduction of ordered products, we will send you a confirmation of the cancellation or reduction prior to issuing a refund.
If you have already received an order confirmation but have not yet received a shipping confirmation, we cannot guarantee that we can cancel or modify your order. You may send an e-mail to @email@example.com with the subject line “Order Cancellation” or “Order Modification.” We cannot guarantee the request will be honored, as products may be shipped out prior to processing your request. If this is the case, please see our Returns Policy below.

5) Price Changes
Prices for products are subject to change at any time without notice. The prices charged for any of the products will be the price in effect at the time the order is placed, as confirmed in your order confirmation. Posted prices do not include sales tax or shipping charges. All such charges will be added to your merchandise total and will be itemized in your shopping cart and in your order confirmation e-mail.
As all of our payment collections are done through a third party, refunds may take up to four weeks to process.
Shipping costs can never be refunded.
7) Discounts and Promotional Codes
From time to time, we may provide you with promotional codes or discounts. Those promotional codes and discounts are limited to our online store during the dates stated on the promotional code or discount or for the duration of the promotion. We cannot honor promotional codes, discounts, or coupons from any stores selling our items at retail locations. Any abuse of our discount or promotional systems will result in being locked out of our system.
1) Product Availability
Out The Box, LLP sells unique items that are listed on the website but also for sale in Out The Box, LLP’s physical store. Out The Box, LLP uses a specialized inventory system that simultaneously updates the website once an item has been purchased, but it cannot guarantee that a simultaneous online purchase and in-store purchase could not happen. Thus, it is possible that an item may have already been sold when you purchase it through the online marketplace. While Out The Box, LLP will refund your purchase and contact you regarding the order cancellation as soon as the issue is realized.
2) Shipping Address
We are currently shipping to the fifty United States and the District of Columbia. Please note that we cannot ship to P.O. boxes. If you would like to purchase items from our store and live outside of this area, please use our Contact Form to let us know where you are located and we will get back to you when that option is available.
If your product is returned to us as undeliverable, we will attempt to contact you via phone or e-mail to obtain a different shipping address. If we are unable to receive a different address from you, we will cancel the order and issue you a refund, minus shipping expenses.
3) Shipping Details and Options
We offer Standard or Express shipping from the United States Postal Services. Standard shipping takes 5-7 business days from the date of shipment. Express shipping takes 1-2 business days from the date of shipment. Please allow additional time for orders in Alaska and Hawaii.
1) Standard Returns
We hope that you never have any reason or need to return your products to us! However, if unopened, you may return your products to us within thirty (30) days of delivery for a full refund. Shipping costs will not be refunded.
2) Ineligible Returns
If you have opened your product, we cannot accept it for return unless it arrived to you damaged or defective.
You may not return products online which you received at a retail store or on eBay. Such returns may only be done at the store at which the product was purchased.
3) Return Process
If you intend to return your products to us, you must inform us prior to the return via e-mail with the subject line “Order Return”. We will confirm that we have received the return request and will send you a return slip to include in your return as well as a shipping address. Please be sure to include the return slip in your return or we will not know the game came from you. We cannot issue refunds for products
returned without a return slip.
We will send you a confirmation e-mail within three days of receiving your return. Please allow two weeks for the processing of a refund.
If we do not receive your return within ten days of sending the return slip, we will send you a failure to return notice, which will allow you an additional five days to return the game to us. If we have not received the game at that point, we will send you a cancellation of return notice, indicating that we have not received the game and therefore will be unable to provide a refund.
Listing or Selling Products
If you would like to list, display, or sell items at or in our physical store, please contact us through the Contact Us page. We will get back to you with the necessary information within one week of your request.
We cannot sell or list items that are not in our physical store. If you are not in the state of Colorado but are in the continental U.S. and are interested in listing your products, please let us know and we will discuss whether we can make arrangements for that.

Out The Box has a mailing list. From this list, you can be informed of special offers, product updates, and more. If you would like to be part of this mailing list, sign up here (firstname.lastname@example.org). Please note that you must opt-in to the mailing list. Simply providing your e-mail address for order purposes will not subscribe you to Out The Box mailing list.
You may unsubscribe from our mailing list at any time by clicking “Unsubscribe” at the bottom of your e-mail or by contacting us on our Contact Us page.
2) Personally Identifiable Information
“Personally Identifiable Information” (PII) is defined as information that can be used on its own or with other information to identify, contact, or locate a single person or to identify an individual in context. Out The Box collects personally identifiable information in receiving your name, e-mail address, phone number, and other details required to deliver your products or provide you with mailing list information. Out The Box does not collect PII when you visit our site without subscribing to our mailing list or placing an order.
3) Other Uses of PII
In addition to fulfilling your orders and providing you information, Out The Box may also use your PII to improve our website: to serve you better; to respond to customer service requests; to run contests, promotions, or surveys; to ask for ratings or reviews of our products; or to follow up with updated correspondence.
4) Protecting Your PII
Our website is scanned by a third-party malware scanner, Sucuri, on a regular basis for security issues and known vulnerabilities in order to make your visit to our site as safe as possible.
Your PII is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep information confidential. In addition, none of your financial information is kept by Out The Box
Your information is kept for no more than three (3) years after your most recent provision or renewal of information.
According to CalOPPA, Out The Box, LLP agrees to the following:

- You can change your information at any time by e-mailing us.
Intellectual Property Policy
All products, content, manuals, instructions, logos, images, and videos on the site and sold on the site are the registered or unregistered copyrights, trademarks, service marks, or patents of Out The Box, LLP and various third parties. The copying of any of the content on this site is an infringement of Out The Box, LLP’s, and possibly others’, intellectual property and a breach of these Terms and Conditions.
Other Policies and Terms
1) No Warranties
All products offered on are provided “as is” without any warranty whatsoever, including, without limitation, any (a) warranty of merchantability, (b) warranty of fitness for a particular purpose, or (c) warranty against infringement of intellectual property rights of a third party, whether express or implied by law, course of dealing, course of performance, usage of trade, or otherwise. Some jurisdictions limit or do not allow the disclaimer of implied or other warranties. The above disclaimer may not apply to you.
2) Notices to You
We may provide any notice to you under these Terms and Conditions by sending a message to the e-mail address you provide or by posting to the home page of www.outtheboxshop.com. Notices sent by e-mail will be effective when the e-mail is sent. Notices provided by posting will be effective upon posting.

To give us general feedback, including complaints, take-down requests, return requests, and changes of e-mail address, you may use the contact us page or e-mail at . We will respond as appropriate.
To provide Out The Box, LLP with official notice under these terms for any conditions requiring it, e-mail notice to is sufficient.

In the event of any disputes or claims arising out of or relating to your use of or your purchase of any products from Out The Box, LLP, you agree to binding arbitration with JAMS under the JAMS arbitration rules in Denver, Colorado. The arbitration shall be before a sole arbitrator. The arbitration shall be confidential. The prevailing party shall be entitled to reasonable costs and attorneys’ fees.
6) No Waivers
The failure by Out The Box, LLP to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision.
If any provision of these Terms is invalid, illegal, void, or unenforceable, that provision will be severed from these Terms without affecting the validity or enforceability of the remaining provisions of these Terms.
